Following President Joe Biden’s issuance of several Executive Orders (EO’s) to limit the energy sector, Texas Governor Abbott issued a state Executive Order that directs every Texas agency to fight back any federal regulations seeking to limit energy production in Texas.
His EO notes the importance of the energy sector in Texas’s economy and the number of Texas jobs directly or indirectly related to that industry. His EO denounces Biden’s move to rejoin the Paris Accords and to move the U.S. closer to “Green New Deal” policies.
NOW, THEREFORE, I, Greg Abbott, Governor of Texas, by virtue of the power and authority vested in me by the Constitution and laws of the State of Texas, hereby direct every state agency to use all lawful powers and tools to challenge any federal action that threatens the continued strength, vitality, and independence of the energy industry. Each state agency should work to identify potential litigation, notice-and-comment opportunities, and any other means of preventing federal overreach within the law.
This executive order supersedes all previous orders in conflict or inconsistent with its terms and shall remain in effect and in full force unless it is modified, amended, rescinded, or superseded by the governor.Governor Abbott, Texas, January 29th, 2021
